PHASIA Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Alyssa Lindaas LLC ("PHASIA", "we", "us") governing your use of the PHASIA mobile app and related services (the "Service"). By downloading or using PHASIA, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy. If you do not agree, do not use the Service.

1. Who can use PHASIA

You must be at least 17 years old (or the age of majority where you live) to use PHASIA. By using it you confirm that you meet this requirement and that you can form a binding contract.

2. What PHASIA is and is not

PHASIA helps you create personal audio tracks: affirmations, in your own voice or an AI voice, played softly beneath a soundscape for rest or sleep.

PHASIA is a personal wellness and self-reflection tool. It is not a medical device and does not provide medical, psychological, therapeutic, or professional advice, diagnosis, or treatment. It is not a substitute for care from a qualified professional. Results are personal, experiential, and self-reported; we make no promise of any particular outcome. If you are in crisis or thinking about harming yourself, contact a crisis line (in the US, call or text 988) or your local emergency number.

3. Your content and recordings

• You own your recordings. You keep all rights to the affirmations you write and the voice recordings you make.
• You are solely responsible for your content. You are responsible for what you record, write, and create with PHASIA, and for ensuring you have the right to do so. You must not create content that violates the Acceptable Use Policy or any law.
• Limited license to operate the Service. You grant us a limited, worldwide, royalty-free license to store, process, transmit, and modify your recordings and inputs only as needed to provide the Service to you (for example, to mix your voice beneath a soundscape and return the finished track to your device). We do not use your recordings or inputs for advertising or to train AI models, and we do not share them except with the processors described in the Privacy Policy.
• Your content stays yours and stays private. PHASIA does not publish or share your recordings with other users. If we ever add features that share content between users, those features will have their own additional terms and controls, and will be optional.

4. AI-generated affirmations

Affirmations may be generated with the help of AI based on the inputs you provide. AI output can be imperfect; you should review and edit the words before using them. We apply safety measures to decline requests for harmful content, but you remain responsible for the final track you create and use.

5. Acceptable use

Your use of PHASIA is subject to the Acceptable Use Policy, which prohibits unlawful, harmful, harassing, infringing, and abusive use. We may suspend or terminate access for violations.

6. Subscriptions and payments

• PHASIA offers a free tier (one track at the one-hour length) and a paid PHASIA Premium subscription that unlocks additional and longer tracks.
• Subscriptions are sold and billed through your Apple App Store account. Payment is charged at confirmation of purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Manage or cancel anytime in your App Store account settings.
• Prices are shown in the app before purchase and may change with notice. Except where required by law, payments are non-refundable; refunds are handled by Apple under its policies.

7. Intellectual property

The Service, including its soundscapes, software, design, and content we provide (excluding your own recordings and inputs), is owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use. You may not copy, resell, redistribute, reverse-engineer, or extract the soundscapes or other Service content except as allowed by law.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL PRODUCE ANY PARTICULAR RESULT. Do not use the Service while driving or in any situation where falling asleep or reduced attention could be dangerous.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR YOUR CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR FIFTY US DOLLARS (USD $50). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or any law or third-party right.

11. Termination

You may stop using PHASIA at any time by deleting the app. We may suspend or end your access if you violate these Terms. Sections that by their nature should survive (ownership, disclaimers, limitation of liability, indemnification, governing law) survive termination.

12. Changes to these Terms

We may update these Terms; the "last updated" date will change, and material changes will be reflected in the app or on our site. Continued use after changes means you accept them.

13. Governing law and disputes

These Terms are governed by the laws of New York, USA, without regard to conflict-of-laws rules. Before filing any claim, you agree to contact us at help@dreamphasia.app and give us 30 days to try to resolve the issue informally. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in New York, New York, and you consent to the personal jurisdiction of those courts. This section applies to the fullest extent permitted by law and does not limit any rights you have under the consumer protection laws of your place of residence.

14. Apple App Store terms

If you obtained PHASIA through the Apple App Store, Apple's Licensed Application End User License Agreement also applies. Apple is not responsible for the Service or these Terms, and is a third-party beneficiary entitled to enforce them.
